FUNFIT FAMILY FITNESS FAMILY PLAN
TERMS, RULES & REGULATIONS
This agreement is made and entered into on
the date of ONLINE submission.
This agreeement is by and between Funfit Inc., corporate address
18800 Heritage Hills Drive, Brookeville, MD 20833 dba Funfit
Family Fitness, 17511 Redland Rd., Rockville, MD 20855,
herein referred to as FUNFIT and the Parent listed above herein
referred to as CLIENT.
Client agrees to the pay $75.00 every month through a recurring debit from a qualifying credit card account for a minimum of 3 months from
the date of this contract, then continuing month-to-month until a 30-day notice is submitted to cancel. This $75/month payment is for 2 classes per week for one child or 1 class per week for 2 children. Additional standard or specialty classes can be addedto this plan for an additional $25/month per child.
CLIENT agrees to follow the terms and conditions
stated under this agreement.
1. LIABILITY WAIVER: CLIENT assumes all responsibility for
any injuries or damages resulting from participation in any
and all activities and programming for self, as well as all
minors in client’s care and guardianship that are on
premises, using equipment on premises and participating in
activities and programming. CLIENT does hereby and forever
release FUNFIT, its owners, employees and agents from all
claims, demands, damages, rights or causes of action, present
or future, anticipated or unanticipated, resulting from or
arising out of CLIENT’s, CLIENT’s guests or CLIENT’s
minor children’s participation and/or intended use of
the facilities and equipment. CLIENT also agrees to hold HEALTHTRAX Fitness & Wellness harmless from any damages resulting in participation of Funfit programming. CLIENT agrees that all photographs/videos/recordings
taken by FUNFIT remain the property of FUNFIT and can be used
by FUNFIT in any advertising or marketing campaign, including
but not limited to the world wide web (internet), television,
radio, publications or any other usage FUNFIT deems necessary.
2. HEALTH WARRANTY: CLIENT warrants and represents to be in
good physical condition and that their minor children or minor
children in their care are also in good physical condition
and fully able to participate in activities and programming.
CLIENT warrants that any physical conditions or disabilities
that they have or their minor children have or any minor children
in their care, have been stated to FUNFIT staff before participation
in activities and programming on the premises. CLIENT warrants
that they are aware that FUNFIT recommends a medical examination
before participation in fitness programming.
3. COLLECTION: In the event payment of agreement is not made
and FUNFIT requires the employment of a collection agency
or attorney to collect moneys due under this agreement, CLIENT
agrees to pay all costs associated with the collection of
debt including but not limited to attorney fees and costs,
agency fees and costs, court fees and costs and any other
reasonable fees associated with the collection of debt.
4. BAD CHECKS OR DEBITS: CLIENT shall pay a $25 SERVICE FEE
for EACH BAD CHECK AND/OR BAD DEBIT due to CLIENT’S
FAULT.
5. REFUNDS AND CANCELLATIONS: This contract has a minimum payment of 3 months before continuing month-to-month unless agreement is cancelled within
3 business days after signed contract is received by FUNFIT, by giving
written notice in person or by certified mail. If CLIENT cancels
agreement within this time period, all monies paid in accordance
with this agreement will be refunded to CLIENT. Otherwise,
agreement can only be cancelled after 3 month minimum is met. To receive refund, CLIENT must provide 30 days written notice
to FUNFIT. There are absolutely no refunds for missed classes.
6. REGISTRATION OF CLASSES: It is the responsibility of the
CLIENT to register for classes, no refunds will be given for
failure to register.
No refunds based on the number of registered classes will
be given.
7. TRANSFER OF CONTRACT: This contract is NON-TRANSFERRABLE
unless otherwise approved by FUNFIT. If transfer is approved,
a $75 transfer fee will be assessed.
8. CENTER CLOSURE: In the event of closure of the FUNFIT
Center or HEALTHTRAX Fitness & Wellness for a month or more, CLIENT has the right to a prorated
refund or extension of agreement. If closure is not the fault
of FUNFIT, CLIENT’s agreement will automatically be
extended to replace time of closure.
9. CLASSES & OPEN GYM: FUNFIT reserves the right to modify
classes, scheduling and open gym time as needed. CLIENT will be
made aware of any class or open gym cancellations and/or changes.
Classes will not meet on scheduled holidays and CLIENT will
be made aware of those holiday observances in advance. Certain
classes and programs, depending on the session, may be excluded
from this plan at the discretion of FUNFIT. Please check for
excluded classes or programs when registering. Refunds will not be given due to a missed class from a holiday. Make-ups are allowed at all times during paid registration.
10. THEFT/DAMAGE: FUNFIT shall not be liable for loss, theft
or damage of personal property of the
CLIENT, CLIENT’s guests or CLIENT’s minor children.
11. There is NO SMOKING and NO ALCOHOLIC BEVERAGES allowed
in either facility at any time.
12. FUNFIT reserves the right to terminate a CLIENT’s
family plan for reasonable cause.
13. CLIENT may bring a guest to participate in a class on
a trial basis with permission from FUNFIT staff.
NOTICE OF CONSUMER RIGHTS
1. We are not required to carry a performance bond under the
Maryland Health Club Services law because we do not accept
more than three months’ payment in advance or charge
initiation fees over $200.
2. If Funfit is closed for a month or more, you are entitled
to your choice of either an extension of the agreement or
a prorated refund. If the closing is not the fault of the
business, we are entitled to choose.
3. You have the right to cancel this agreement within three
business days after receipt of a copy of this agreement. Cancellation
must be in writing, and delivered in person or by certified
or registered mail. If you cancel, you are entitled to a full
refund of all monies paid.
4. If you become disabled for at least 3 months during the
membership term and the disability is confirmed in writing by a physician, you
are entitled to an extension of this agreement. Since we are exempt from the bonding requirement,
we cannot collect payments during a member’s disability
extension so that we are not holding more than three months’
payment in advance.
This notice is an integral part of the application and agreement
for the FUNFIT Family Plan.
I understand and agree to all the terms, rules
and regulations stated in this agreement and accept full responsibility
for all minor children in my care under this agreement. By
submitting this agreement I agree to all terms and this submission
will serve as my legal signature. I have printed a copy of this contract as official receipt. I understand that the initial start date of contract is date 1st & last payment is received by Funfit if different from date below.
